    Judicial Approaches and Landmark Cases

    Courts have adapted traditional jurisdiction principles to cyber contexts through several landmark decisions. In Microsoft Corp v United States(2018) (Microsoft Ireland Case), the court highlighted the limits of domestic authority in accessing data stored on foreign servers, emphasizing conflicts between territorial sovereignty and digital evidence control.

    Google LLC v. CNIL, CJEU, 2019

    The Court of Justice of the European Union ruled that national laws, such as the “right to be forgotten,” cannot automatically apply globally. This case emphasizes the limits of extra-territorial application of domestic laws in digital contexts.

    United States v. Ivanov, D. Conn., 2001

    A landmark early cybercrime case where a Russian hacker attacked U.S. companies remotely. The court asserted U.S. jurisdiction because the effects of the crime were felt within its territory, illustrating the effects-based principle in cyber law

    To effectively address cross-border cybercrime, Bangladesh should strengthen international cooperation by joining global frameworks such as the Budapest Convention on Cybercrime and negotiating bilateral agreements. Domestic laws should be updated to clarify extra-territorial jurisdiction and streamline procedures for accessing foreign digital evidence. Investment in cyber forensic infrastructure, specialized training for law enforcement and the judiciary, and collaboration with technology companies are essential to enhance investigation and prosecution capacity. A coordinated national strategy combining legal reform, institutional capacity, and international engagement will ensure Bangladesh can respond effectively to transnational cyber threats.Strengthening these areas will enable Bangladesh not only to protect its citizens but also to assert its role in the global fight against cybercrime, ensuring justice in the borderless realm of cyberspace.

    Conclusion:

    Cybercrime challenges the foundational assumptions of criminal jurisdiction. The borderless nature of digital activity renders traditional territorial principles insufficient. While international frameworks

    provide a starting point, they are not yet adequate to address the complexity of cross-border cyber offences.

    A coordinated global approach—combining legal reform, technological advancement, and international collaboration—is essential to ensure effective prosecution of cross-border cybercrime.

    Strengthening these areas will enable Bangladesh not only to protect its citizens but also to assert its role in the global fight against cybercrime, ensuring justice in the borderless realm of cyberspace
